When is causing a "nuisance" a crime? (Penal Code 372 & 373a)
What is a "public nuisance"? When is it a crime to create a nuisance? Can I go to jail? In this video, a former D.A. answers these questions.
California Penal Code 272 and 273a make it a misdemeanor crime to create or continue a public nuisance on your property. A public nuisance is defined as something that creates a danger or a disturbance or that offends a whole community of people (as opposed to just one or two neighbors).
The crime of creating a public nuisance is more than just an infraction or civil code violations. Penal Code 272 makes it a misdemeanor punishable by up to 6 months in county jail. Nevertheless, a good criminal defense lawyer can often get these charges dismissed.

Britons were bombarded with 3.9 billion nuisance phone calls and text messages last year — the equivalent of 7,420 every minute, according to watchdog Ofcom. The Government has pledged to introduce a law by the end of the month that will ban cold calls about pensions. This means that firms will no longer be permitted to ring people at home out of the blue.
